By-law # 10: Regarding the installation of water systems within subdivisions of land in GID
section 1: owner of proposed subdivision or owner who subdivides any parcel of land within GID, shall submit plan to GID regarding approval of waterworks system to be installed.
section 3: owner shall install system at own expense and pay capital expenditure and connection charges (also see bylaw 19 section 1 and bylaw 23 section 3 a).
By-law #15: Regarding the regulation and distribution and use of water and prescribing penalties for non-compliance.
Service connections:
section 4: before any installation or construction any water works related or connected to GID, the owner shall apply to GID in writing and obtain a written permit .
section 5: After completion or before works are covered, the trustees shall be notified that such works are ready for inspection.
Change of occupancy:
section 6: no agreement between the occupant and GID with respect to services of one premise may be transferred to another occupant. New occupants shall apply in writing to GID for water service.
Turn off and turn on
section 7: Consumers who wish to have their water service discontinued shall pay the turn off charge and give 14 days notice. Before service is renewed a turn on charge needs to be paid.
section 8: The trustees may order the water turned off to any premises where tolls have been owing to the GID. (also see bylaw 68 section 3)
Trustees right of access:
section 9: a. The trustees shall have right of access to all parts of a property at all hours of the day for the purpose of inspecting or testing any works related to the use of water, etc.
b. No person shall obstruct or prevent the trustees from carrying out any provisions of this bylaw.
District works:
section 10: No person except the trustees, shall open, etc. or tamper with any of the districts water works.
section 11: No person shall obstruct the access to any fixture connected to GID works.
Works on private property:
section13: No person to whose premises water is supplied shall make, or permit to be made any additional connection to his service of either temporary or permanent nature , for the purpose of supplying water to another building on his or any other property, without permission of the trustees.
Section 14: No person shall interconnect any portion of works on private property which are supplied by the District with any external source of water. The owner of the property must have an air-gap brake to any such contaminator, such as hot tubs, ponds, pools, or other sources of water on approval of the Trustees.
section 15: No changes to GID works for the purpose of expanding Commercial or Industrial enterprise shall be made until notice has been given in writing to the trustees and written permission obtained. Any extra charges shall be paid before changes commence.
section 16: No person shall use a pump or other device for the purpose of increasing the pressure in any pipe without written permission of the trustees. GID may , without notice, discontinue service to any person employing such devices.
section: 18: Property owner is responsible for all maintenance of all service pipes from the GID's curb stop or waterworks valve at the property line.
Water use regulations:
section 20: If the trustees believe the quantity of water being used or the rate which it is being used is excessive, the GID may take measures.
section 22: No owner/occupant of any premises, supplied with water by GID, shall sell, dispose of or give away water except by permission of trustees.
section 23: a. No person shall use water for watering stock, filling pools or reservoirs without written permission.
b. An approved swimming pool shall be equipped with recirculation and filtration system as set out in Health Act.
c. GID water may not be used as motive power for operating machinery without permission of the trustees.
section 24: a. Trustees may at any time introduce regulations restricting the use of water for sprinkling or other purpose.
b. No person shall, without permission of the trustees:
(I) use water for sprinkling in excess of reasonable requirements; or
(II) use an open pipe or hose for sprinkling purposes; or
(III) irrigate more than 1/4 acre of land (including that occupied by dwellings)
Liability of District:
section 25: The District does not guarantee a specific pressure or a continuous supply of water quality to meet special requirements of individual users.. GID reserves right to interrupt water service for repairs, etc. Affected water users will be notified.
Penalties:
section 26: The trustees may, on 24 hours written notice, turn off the supply of water to anyone in default of this bylaw. Until the default is remedied it is unlawful, for anyone to turn their water back on.
section 27: Anyone who does not comply with any provisions of this bylaw, is guilty of an offence and liable to summary conviction to a $500 fine or imprisonment not exceeding 30 days or both. ("None of the options for enforcing bylaw provisions that involve the courts should be undertaken without a resolution of the board and the advice of legal counsel. Improvement Districts do not have authority to levy fines." )(British Columbia Ministry of Community Services Improvement District Manual Section B page 17)
Current tax and toll rates for 2020:
Toll: section 1: (a) each single family dwelling or serviced vacant lot an annual toll of $250.
(b) each single family dwelling utilized as a multiple family dwelling an annual toll of $500.
(c) each additional dwelling, cabin, trailer or other accommodation on the same parcel of land an annual toll of $250.
Tax: section 1: an annual tax of $175 per connection (see rates and policies or full text bylaws)
